Terms of Use

1. Agreement

By creating an account or continuing to use BandHQ ("Service"), you agree to these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

BandHQ is a mobile app for bands and musicians to coordinate gigs, rosters, venues, travel, documents, messaging, guest lists, supply requests, reminders, venue ratings, and related band operations. Features may change as we improve the product. Some information is visible only to certain roles, for example band leaders.

3. Eligibility

You must be at least 18 years old to use the Service. By using BandHQ, you represent that you meet this requirement and that the information you provide is accurate.

4. Accounts and Authentication

You sign in with a verified phone number using an SMS one-time passcode. You are responsible for safeguarding access to your device and phone number, and for all activity under your account. Notify us promptly if you suspect unauthorized access.

5. Acceptable Use

You agree not to misuse the Service, including violating applicable laws, attempting unauthorized access, interfering with the Service, uploading malware, harassing or threatening others, sharing others' personal information without permission, or using the Service to distribute spam or unlawful content.

6. User Content and Band Data

You retain ownership of content you submit, including photos, documents, messages, venue notes, guest names, and other band data. You grant BandHQ a license to host, store, process, transmit, and display that content as needed to operate the Service for you and your band members.

When you join or create a band, band-scoped content you add may be visible to other members of that band according to product design and your role. You are responsible for invite codes, roster membership, and what you upload or share.

7. Sensitive Information

You may store sensitive business or personal information in the app, for example tax forms, pay rates, lodging confirmations, venue credentials, or guest list names. You are responsible for ensuring you have the right to upload and share that information with your band. BandHQ does not provide tax, legal, or financial advice.

8. Third-Party Services

The Service relies on third parties, such as Google Firebase for authentication, storage, and backend services, and Apple services for maps, geocoding, weather, push delivery, and device features. Your use of those features may also be subject to those providers' terms and policies.

9. Push Notifications and Device Features

The Service may send push notifications about gigs, roster changes, band messages, reminders, and other band activity. You can manage notification permissions in your device settings. Optional features may request access to your contacts, camera, or photo library.

10. Subscriptions and Payments

BandHQ offers an optional paid subscription ("BandHQ Pro") with monthly and yearly auto-renewing plans sold through the app store where you subscribed. Plan prices, any free-trial length, and included features are shown in the app at the time of purchase.

A BandHQ Pro subscription belongs to the purchasing band owner and provides eligible access to every band that person owns, including invited members using those bands. Invited members do not purchase access for someone else's band. If the owner's trial or subscription ends, joined-member access to that band may be paused until the owner restores billing; band data is not deleted solely because a subscription ends.

If you start a free trial, you will not be charged until the trial period ends unless you cancel first. After a trial or promotional period ends, your subscription renews automatically at the price shown for your plan unless you cancel at least 24 hours before the end of the current billing period. Payment is charged through the app store account you used to subscribe. You can manage or cancel subscriptions through your App Store or Google Play subscription settings.

We use RevenueCat and app store providers to validate purchases and may store your subscription status, such as product ID, trial state, and renewal date, on our servers to unlock Pro features for your account. Refunds are handled by the app store where you purchased according to that store's policies, not by BandHQ directly.

A free tier with limited features may remain available. We may change plans, pricing, or features with notice where required by law or platform policies.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT GIG, TRAVEL, OR FINANCIAL INFORMATION IN THE APP IS ACCURATE OR COMPLETE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BANDHQ AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

13. Termination

You may stop using the Service at any time and may delete your account in the app, subject to restrictions if you own bands. We may suspend or terminate access for violations of these Terms or to protect the Service.

14. Changes

We may update these Terms. We will post the updated Terms with a new "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms.
